Medical Definition and Legal Framework in Chile

one electronic medical prescription in Chile must meet the health and identification requirements of the prescriber and the patient. Article 38 of the D.S. No. 466 contemplates advanced electronic signature or systems enabled with prescriber validation through ClaveÚnica. A signature image or a PDF, on their own, does not prove compliance. For controlled medications, the specific requirements of their prescription method also apply.

In Chile, a prescription issued during telemedicine care can be delivered in electronic format when it meets the requirements applicable to its type. The final dispensation always depends on the pharmacy's validation and the health requirements of the prescribed medication.

In this article we explain the basic elements of an electronic prescription and the differences between a simple prescription, a prescriptions retained by the dispensing pharmacy and a special controlled-drug prescriptions (receta cheque). Prior medical evaluation and correct identification of the patient remain essential.

What makes an Electronic Prescription valid?

The prescription must contain the identification of the professional and the patient, date of issue, medication, dosage, pharmaceutical form, dosage and other data required for the type of prescription. In addition, it must allow verification of its authorship and integrity:

  • Signature and verification: The mechanism must allow the issuing professional to be identified and the integrity of the document to be verified according to the platform used and the type of prescription.
  • Folio or validation code: When incorporated into the system, it facilitates authenticity verification and dispensing control.
  • Identification of the Doctor and the Patient: The RUT, full name and SIS record of the doctor must clearly appear, along with the patient's personal data.
The electronic prescription does not eliminate health controls: the pharmacy must review the type of prescription, its validity, integrity and the requirements of the medication.

Types of Prescriptions and their validity through Telemedicine

It is important to distinguish the type of prescription according to the danger and regulation of the prescribed drug:

  1. Simple recipe: It is used in medications that do not require a prescriptions retained by the dispensing pharmacy or a special controlled-drug prescriptions (receta cheque). It can be delivered in electronic format if it meets the corresponding data and validation mechanisms.
  2. Recipe retained: The pharmacy retains or records the prescription when dispensing controlled medications. Its issuance and use must comply with the specific health regime and the corresponding authorized system.
  3. Recipe check: It is required for certain narcotic and psychotropic drugs subject to special control. It has reinforced formal and traceability requirements; It should not be treated as a simple PDF recipe.

How long does a medical prescription last in Chile? (Legal validity and deadlines)

One of the most frequent doubts patients have when purchasing their medications is how long does a prescription last before losing legal validity in pharmacies. In Chile, the validity periods depend on the type of medication and the current health regulations (Health Code, D.S. No. 466, D.S. No. 404 and D.S. No. 405 of MINSAL):

  • Simple medical prescription: The duration of treatment should not be confused with a universal delivery period. Review the date, prescriber instructions, and requirements applicable to the medication; Consult your doctor or pharmacy if you have any questions.
  • Chronic treatments: In pathologies requiring continuous treatment (such as high blood pressure, diabetes or hypothyroidism), the treating physician may authorize periodic deliveries or dispensations in accordance with the applicable health regulations.
  • Withheld prescriptions and controlled medications: The prescription and dispensing of drugs subject to a withheld prescription or special controlled-drug prescriptions (receta cheque) (governed by S.D. No. 404 and No. 405 of the MINSAL and provisions of the Institute of Public Health) are subject to the deadlines, retention requirements and specific health controls corresponding to each active ingredient and regulated format.
  • Official check recipe: Regulatory forms subject to inspection and special control measures according to current health regulations in Chile.

If your prescription has already expired or you have run out of medication for your ongoing treatment, it is essential not to self-medicate or abruptly stop taking medications. A new medical evaluation is required to verify the dosage and issue a valid updated prescription.
